preparing the case against Rogers.

Twenty minutes ago,

I received an ex parte application from the defense.

And after reviewing it,

I am inclined

to grant them an emergency continuance.

Brian, what the hell is going on?

Objection.

The prosecution was not made aware

- of this application. - Your Honor,

perhaps the prosecution needs to brush up on their Latin.

Ex parte means "one side only."

And perhaps the defense should brush up on the law.

They are still required to give notice.

I share your frustration,

but these are

highly unusual circumstances.

with the Justice Department?

In exchange for immunity

and witness protection, Rogers has agreed

to hand over valuable intel to the United States.

- What intel? - Apparently it's classified

it has not been dismissed.

No one's signed on the dotted line yet.
